This Privacy Policy (this "Policy") describes how miaddy ("miaddy," "we," "us," or "our") collects, uses, and discloses information in connection with the miaddy mobile application (the "App"). By using the App, you agree to the practices described in this Policy and in our Terms of Service (the "Terms").
1. Information We Collect
We collect the following categories of information in connection with your use of the App: (a) Contact Information, meaning the name and email address you provide when creating your account (your "Account"); (b) User Content, meaning content you create within the App, including plans, moments, notes, tags, and preferences that personalize your experience, as well as the names and details of people you add to your circle; (c) Identifiers, meaning a unique user ID associated with your Account and device identifiers such as your push notification token; (d) Purchase History, meaning records related to your miaddy+ subscription status and transactions; and (e) Diagnostic Information, meaning crash and performance data collected automatically, which is not linked to your identity.
2. Information About People Who Aren't miaddy Users
The App permits you to add individuals to your circle and to invite individuals who are not yet miaddy users by submitting their name and/or email address. By submitting this information, you represent that you have the right to share it with us. We use this information solely to facilitate the invitation and connection features you request. As set forth in the Terms, you are responsible for, and agree to indemnify us against, any claim arising from information you submit about another individual.
3. How We Use Your Information
We use the information described in Section 1 for the following purposes: (a) to provide, maintain, and improve the App; (b) to create, authenticate, and manage your Account; (c) to facilitate the plans, reminders, and invitations you initiate; (d) to generate suggestions and notifications intended to personalize your experience; (e) to process subscription purchases and manage billing; (f) to monitor, diagnose, and resolve technical issues; (g) to communicate with you regarding your Account or this Policy; (h) to detect, investigate, and prevent misuse, fraud, or violations of the Terms; and (i) to comply with applicable law, regulation, or legal process. We do not sell your personal information, and we do not use it for any purpose materially different from those described in this Policy without providing notice.
4. How We Share Your Information
Your name and the details of a plan (including its date, time, and location) are visible to the individuals invited to that plan. Moments, which are created after a plan takes place, are private to your Account; if a moment includes other people, they are identified only as attendees within your own record and are not given access to that record. We disclose information to third-party service providers who process it solely as necessary to provide their services to us, including providers of: (a) database hosting and authentication; (b) email delivery; (c) location search suggestions; (d) payment and subscription processing; (e) crash and performance monitoring; and (f) push notification delivery. This list is illustrative and may change as we adopt new service providers. Each provider is responsible for its own handling of information under its own privacy practices, which we encourage you to review. We may further disclose information where required by law, to enforce the Terms, or to protect the rights, property, or safety of miaddy, our users, or others. We do not sell or share information for advertising purposes.
5. Data Retention
We retain your information for as long as your Account remains active or as reasonably necessary to provide the App's features. Information regarding an individual you have invited who is not a miaddy user, namely their name and/or email address, is retained until you cancel the invitation within the App; cancellation updates the status of that invitation but may not immediately erase the underlying record. You may request deletion of this information at any time by contacting us at [email protected]. Upon deletion of your Account, we will delete your personal data within thirty (30) days, except to the extent we are permitted or required to retain it, including to resolve disputes, enforce our agreements, prevent misuse, or comply with law.
6. Your Rights and Choices
You may: (a) access, update, or correct your profile within the App; (b) delete your Account at any time through the App's settings; (c) opt out of push notifications through your device settings; and (d) request a copy of your personal data by contacting us at [email protected].
7. Data Security
We implement industry-standard security measures, including encrypted connections (HTTPS/TLS) and secure authentication protocols. You are responsible for maintaining the confidentiality of your account password. No method of transmission or storage can be guaranteed to be completely secure, and we make no representation or warranty to that effect.
8. Disclaimers and Limitation of Liability
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, miaddy and its operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, from content submitted by you or other users, or from any unauthorized access to, or alteration of, your information. This Section summarizes certain disclaimers applicable to your use of the App; the complete limitation of liability is set forth in the Terms, which shall govern in the event of any conflict between this Policy and the Terms. This Policy is governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles.
9. Children's Privacy
The App is not intended for individuals under the age of thirteen (13). We do not knowingly collect personal information from children under thirteen (13), and we will delete such information promptly upon becoming aware of it.
10. Changes to This Policy
We may amend this Policy from time to time. We will notify you of material changes by posting the revised Policy within the App or on this page and updating the date set forth above. Your continued use of the App following the posting of any changes constitutes your acceptance of the revised Policy.
